1. About Invitofy
Invitofy is a digital invitation platform operated from the United Kingdom. The Service allows users to create, design, and send digital event invitations via email and WhatsApp. We are an independent software service and are not affiliated with, endorsed by, or in any way connected to Meta Platforms, Inc. (WhatsApp), Google, or any other third-party service referenced on this platform.
2. Service Provided "As Is"
The Service is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, Invitofy expressly disclaims all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Any warranty that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components
- Any warranty regarding the accuracy, reliability, completeness, or timeliness of any content or results obtained through the Service
We do not guarantee that the Service will meet your requirements or that any defects will be corrected. Use of the Service is entirely at your own risk.
3. Limitation of Liability
To the maximum extent permitted by English law, Invitofy, its directors, employees, agents, affiliates, and service providers shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to:
- Loss of profits, revenue, data, goodwill, or business opportunities
- Loss of or damage to invitation data, guest lists, event information, or uploaded media
- Failure to deliver invitations via email or WhatsApp
- Any technical failures, downtime, or interruption of the Service
- Any action or decision made by you or your guests based on the use of this Service
- Any third-party actions, including but not limited to account suspensions, message blocking, or content removal by WhatsApp, Google, or any other platform
This limitation applies whether the claim is based on contract, tort (including negligence), statute, or any other legal theory, and whether or not we have been advised of the possibility of such damages.
4. WhatsApp Usage and Number Blocking
Invitofy provides optional integration with WhatsApp to allow users to send invitation messages. By using this feature, you fully acknowledge and agree to the following:
- Blocking risk: WhatsApp may restrict, limit, or permanently ban any phone number that is flagged for sending bulk messages, automated messages, or messages to recipients who report them as spam. Invitofy accepts no responsibility whatsoever for any such restriction, suspension, or permanent blocking of your WhatsApp number.
- Your responsibility: You are solely responsible for how you use the WhatsApp sending feature, the content of your messages, the volume of messages sent, and compliance with WhatsApp's Terms of Service.
- No affiliation with WhatsApp: Invitofy is not affiliated with Meta or WhatsApp. We do not guarantee that messages will be delivered, and we are not responsible for any changes to WhatsApp's platform or policies that may affect this Service.
- Independent tool: The WhatsApp connection feature operates by linking your personal WhatsApp account. Invitofy does not own, control, or access your WhatsApp account beyond what is technically required to send your invitation messages.
- Risk is yours: Any damage, loss, or inconvenience caused by your WhatsApp number being restricted or banned is your sole responsibility. Invitofy will not offer any compensation, credit, or remedy in such circumstances.
5. Your Data and Privacy
You retain ownership of all content you upload, including invitation templates, guest lists, and event details. By using the Service, you grant Invitofy a limited licence to store and process this data solely for the purpose of delivering the Service to you.
We do not sell your data or your guests' data to any third party. We do not use your WhatsApp number or your guests' phone numbers for any purpose other than sending the messages you explicitly trigger through the platform. See our Privacy Policy for full details.
6. Acceptable Use
You agree not to use the Service to:
- Send spam, unsolicited messages, or messages to people who have not consented to receive them
- Distribute illegal, offensive, defamatory, or harmful content
- Attempt to circumvent any technical measures or rate limits
- Use the Service in any way that violates the terms of WhatsApp, Google, or any other third-party service
- Impersonate any person or organisation
We reserve the right to suspend or terminate your account at any time if we reasonably believe you are violating these Terms or abusing the Service, without prior notice and without liability.
7. Service Availability and Changes
We do not guarantee continuous, uninterrupted access to the Service. We may modify, suspend, or discontinue any part of the Service at any time without notice or liability. We may also update these Terms at any time. Continued use of the Service following any changes constitutes your acceptance of the revised Terms.
8. Third-Party Services
The Service integrates with third-party platforms including WhatsApp, Google, and Facebook for authentication and messaging. Your use of those platforms is governed entirely by their own terms of service. Invitofy is not responsible for the availability, accuracy, or actions of any third-party service.
9. Intellectual Property
All software, design, and content forming part of the Invitofy platform (excluding user-uploaded content) remains the intellectual property of Invitofy. You may not copy, reproduce, distribute, or reverse-engineer any part of the platform without written permission.
10. Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
